Parole in Place

On June 18th, President Biden introduced a new process benefiting non-citizens of U.S. Citizen spouses. Parole-in-place ("PIP") makes it easier for eligible non-citizens who are granted PIP to apply for permanent legal residency through their marriage to a U.S. citizen without the need to leave the United States.

Starting on August 19th, USCIS will begin accepting applications. Applications submitted before the mentioned date will be rejected. It is expected that this new order will help approximately half a million spouses of U.S. citizens and 50,000 non-citizen children whose parents are married to a U.S. citizen.

Eligibility

According to the announcement, individuals who wish to apply under this process must meet the following eligibility requirements:

  • Be present in the United States without admission or parole.

  • Have continuous presence in the United States for at least 10 years as of June 17, 2024.

  • Have a legally valid marriage to a U.S. citizen as of June 17, 2024.

  • Have no disqualifying criminal record or otherwise represent a threat to national or public safety.

  • Merit a favorable exercise of discretion.

How to start preparing

Applicants  can start gathering evidence of continuous presence in the United States for at least 10 years as of June 17, 2024 by collecting documents showing any of the following for the required 10 year period:

  • Work History

  • Medical History

  • School History

  • Receipts or Lease agreement

  • Bank Statements

  • Taxes

  • Paychecks

  • Utility bills

Personal Documentation:

  • Birth certificate (applicant, beneficiary, and children) 

  • Valid passport; or any government issued document bearing the requestor’s name, date of birth, and photo.

  • Valid state or country driver’s license or identification

  • Marriage Certificate​

  • Proof of spouse's citizenship (passport or Naturalization Certificate)
